Coburn & Co Pty Ltd (“Coburns”, “we”, “us”, “our”) operates the Coburns Trunk Club (“Trunk Club”, “Membership”).

2. Eligibility & Age Restriction

2.1 Membership is available to individuals aged 18 years and over in Australia (or of legal drinking age in their jurisdiction).

2.2 By joining or purchasing, you warrant that you are of legal drinking age.

2.3 Deliveries require an adult (18+) signature. ID may be requested; if not provided, delivery may be refused.

2.4 If purchasing as a gift, the recipient must also be of legal drinking age.

 

3. Membership Features

3.1 Joining the Trunk Club requires a Join Fee of AUD $500, which includes your first bottle of Coburns whisky and your hand-crafted Coburns Trunk (see clause 9).

3.2 Member Access & Priority

3.2.1 Trunk Club Members receive priority access to Coburns whisky releases, including early access windows, allocation privileges, and exclusive offers as determined by Coburns from time to time.

3.2.2 Coburns may, at its discretion, offer certain whisky releases to non-members, whether concurrently or after a member priority period.

3.2.3 Access to specific releases may vary by product and will be communicated at the time of release.

3.3 Memberships are personal to you, linked to your Coburns account, and not transferable.

 

4. Right to Refuse or Revoke Membership

4.1 We may refuse any application at our discretion.

4.2 We may suspend or cancel a Membership without refund for serious or repeated breaches, including resale without consent.

4.3 Suspension or cancellation does not limit any other rights we may have.

 

5. Membership Term

5.1 Commencement. Your Membership begins on your Join Date once your Join Fee has been paid in full and your order has been confirmed.

5.2 Ongoing Membership. Trunk Club Membership does not expire.

5.3 No Automatic Renewal Fees. There are no annual renewal fees. Membership remains active unless cancelled by you or terminated by us in accordance with these Terms.

5.4 Member Status. While your Membership remains active, you retain access to Members-only products and benefits, subject to availability and these Terms.

5.5 Cancellation by Member. You may request cancellation of your Membership at any time by contacting us in writing. The Join Fee is non-refundable.

5.6 Termination by Coburns. We may suspend or cancel Membership in accordance with clause 4 (Right to Refuse or Revoke Membership).

 

6. Fees & Payment

6.1 The Join Fee and any applicable delivery charges are displayed at checkout and include GST unless stated otherwise.

6.2 Payment must be made in full at the time of joining or ordering. We accept the payment methods displayed at checkout.

6.3 If payment fails, your Membership will not be activated until full payment is received.

 

7. Members-Only Products & Personal Use

7.1 Certain Coburns whisky releases may be reserved exclusively for Trunk Club Members. Other releases may be made available to the public at Coburns discretion.

7.2 All Coburns products are sold for personal enjoyment or gifting only and may not be resold without our written consent.

7.3 We may cancel orders or memberships where we believe products are being acquired for resale or misuse.

 

8. Orders, Acceptance & Availability

8.1 All orders are subject to availability and Coburns acceptance.

8.2 A contract of sale is formed when we dispatch your order.

8.3 We may limit quantities per member per release to maintain fairness.

8.4 We will not substitute products without your consent.

 

9. The Coburns Trunk & Bottle Returns

9.1 Each new member receives a Coburns Trunk, designed for long-term reuse and bottle returns.

9.2 The Trunk is yours to keep and forms part of your Join bundle. We encourage reuse with every bottle return and refill.

9.3 Complimentary empty bottle returns (within Australia): When you purchase a new bottle of Coburns whisky, you can return your empty bottle in your Trunk at no cost.

9.4 How to book a complimentary return: At checkout for your new bottle, tick the checkbox labeled “Return my empty bottle”. We will contact you within two business days to provide a complimentary return shipping label and instructions for your Trunk and bottle return.

9.5 Complimentary Trunk returns are available only within Australia and only in conjunction with a new Coburns whisky bottle purchase.

9.6 Please pack your Trunk carefully when returning. You are responsible for any damage or loss until the carrier scans the parcel.

9.7 Damaged or lost Trunks during delivery should be reported within 7 days with photographs so that we can assess and resolve the issue.

 

10. Delivery

10.1 Deliveries occur Monday–Friday, during business hours, to Australian street addresses only.

10.2 An adult (18+) must be present to sign for delivery. If absent, the carrier will leave re-delivery or collection instructions.

10.3 We are not responsible for delays due to incorrect address details or circumstances beyond our control.

10.4 Do not accept parcels that appear heavily damaged; have the driver note the damage and contact us immediately.

10.5 Delivery fees (if any) are shown at checkout. Trunk bottle returns are complimentary within Australia when booked with a new bottle purchase (see clause 9).

 

11. Returns, Refunds & Replacements

11.1 No Change-of-Mind Returns. All Trunk Club Join bundles are final once purchased. Goods are allocated and prepared for dispatch immediately and cannot be amended or cancelled.

11.2 Faulty or Damaged Items. If your Join bundle or any product arrives damaged, incomplete, or faulty, notify us within 7 days with photos. We will repair, replace, or refund as required by the Australian Consumer Law (ACL).

11.3 Opened Bottles. Whisky bottles cannot be returned once opened unless faulty.

11.4 All refunds or replacements (where applicable) will comply with the ACL.

 

12. Pricing, Taxes & Errors

12.1 Prices and specifications may change without notice. All prices include GST unless otherwise stated.

12.2 If an error occurs in pricing or description, we will contact you prior to dispatch. You may proceed at the corrected price or cancel for a refund.

12.3 Promotions and referral offers are subject to their stated terms and may change or end at any time.

 

13. Responsible Service of Alcohol

13.1 Coburn & Co supports the Responsible Service of Alcohol.

13.2 We and our delivery partners may refuse supply if we believe it would breach RSA guidelines or the law.

13.3 Alcohol will never be left unattended or supplied to minors.

 

14. Privacy & Cookies

14.1 Your personal information is handled in accordance with our Privacy Policy.

14.2 We use cookies and similar technologies as described in that policy.

 

15. Liability

15.1 Nothing in these Terms limits your rights under the Australian Consumer Law.

15.2 Subject to those rights, Coburns is not liable for indirect, incidental, or consequential loss, including loss of profit or data.

15.3 Our total liability for any claim relating to a purchase is limited to the amount paid for that product.

 

16. Force Majeure

We are not liable for any delay or failure to perform our obligations caused by events beyond our reasonable control, including natural disasters, supply shortages, or transport disruptions.

 

17. Amendments

We may amend these Terms from time to time. Updated Terms will be posted on our website and apply from their effective date. Substantial changes to Membership conditions will be communicated to current Members.

 

18. Governing Law

These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales and the Commonwealth of Australia.
